Erika Jayne is heading to trial for a civil lawsuit and is being sued for over $24,000,000) by Tom Girardi‘s bankruptcy trustee, Elissa Miller.
According to reports from The US Sun, Miller filed the suit against Erika in September 2021. Allegedly, Elissa knew that Erika’s estranged husband’s firm, Girardi Keese, was secretly paying her expenses between 2007 and 2020.
News broke that Judge Anne Hwang has been assigned to the case. Soon, a trial date will be set in District Court, likely after June.
What Erika faces:
The trustee argued in court docs that EJ used Tom’s personal American Express credit cards to pay for expenses she acquired while chasing pop music stardom.
“The Debtor paid all of the Defendants’ billings/invoices incurred by the Defendants.” This was “for services obtained or products purchased by Ms. Girardi in pursuit of her entertainer/actor/singer/writer career.”
The prosecution claimed the charges and invoices were paid for by Tom and recorded on his books and records as advances (loans). The amount exceeded $24,0000.”
A source claimed Erika is “never going to settle.”

Tom Girardi was found guilty last year of four counts of wire fraud after being accused of embezzling $15 million from clients in a ’10-year Ponzi scheme.’
With that said Erika has never been charged with a crime. She’s consistently denied any wrongdoing. She insisted she was left in the dark regarding Tom’s crimes.
