Don’t Be Tardy’s KJ Biermann could face strict conditions if he is released from jail while awaiting trial in his sexual assault and sodomy case.
Page Six spoke with sexual assault case expert and former prosecutor Lindsay Richards about the 15-year-old’s legal situation. Lindsay Richards is not involved in KJ’s case and was speaking based on her professional experience.
According to Lindsay, KJ could be subject to “close, close monitoring” if he is granted bond.
“I think there’s a likelihood he’ll be released,” Lindsay said, adding that he would likely face numerous conditions. “He will have a lot of conditions of his release. I think he’ll be on a GPS. He’ll probably be on house arrest, having to do school at home.”
Lindsay also said KJ could potentially be required to participate in educational programs and therapy before the case goes to trial.
She stressed that the charges against KJ are “unbelievably serious” and could result in decades behind bars if he is convicted. Lindsay Richards suggested that his continued detention could indicate that prosecutors believe they have a strong case, although remaining in custody does not establish guilt.
“Not releasing him into the custody of his parents with electronic monitoring of some kind, that surprises me for this young of a kid,” Richards said. She also believes prosecutors may be seeking to have KJ tried as an adult.
KJ was arrested on charges of aggravated sodomy and aggravated sexual battery involving a 15-year-old classmate. His attorney, Jason Sheffield, previously told Page Six that his client is “100% innocent” and claimed he has evidence that will prove KJ’s innocence.
Kroy Biermann and Kim Zolciak‘s son is scheduled to appear in court tomorrow, September 8.
