Bethenny Frankel has sage legal advice for Kim Kardashian, who passed the baby bar in 2021.
After the Real Housewives of New York alum’s ten-year battle with her ex, Jason Hoppy, she gave her expertise to Kim regarding caring for children with an irrational ex in the picture.

The Kardashians‘ star was threatened by her ex-husband, Kanye West, that he was “going to war” if she didn’t let their oldest child, North West, appear in a song featuring Diddy.
Over the weekend, Kim’s ex leaked texts regarding Kim having trademarks of their kids’ names. Kim told Kanye, “When she’s 18, [the trademark] goes to her. So stop. I sent paperwork over so she wouldn’t be in the Diddy song to protect her.”
North’s father replied, “Amend it or I’m going to war. And neither of us will recover from the public fallout. You’re going to have to kill me.” He ended up releasing the song anyway, writing on social media that men “make the final decisions.”

While preparing a fruit salad, the former Real Housewives of New York star pointed out, “Kim is texting Kanye, who is not a rational person. She’s texting him as if he’s a rational person.”
“She should not be speaking to him at all. She should be speaking to him by proxy. He’s sharing her texts, and that’s a violation.”
Bethenny advised Kim not to focus on the trademark, but prioritize obtaining “decision-making” rights for her children instead. The B Strong founder noted, this the “most crucial” aspect of a divorce. “God forbid something happens” resulting in “big-ticket decisions” being made in medical, educational, and religious matters.
“[A] sane, rational, non-punitive party [needs] to be making those decisions.” She continued, “If Kim has decision making, it’s [irrelevant] whether or not she has the trademark for her daughter. A [custody] judge doesn’t care about trademarks as much,” like a business lawyer would.
According to Bethenny, judges dealing with custody matters are “always focused on what is in the best interest of the child, even if their agreement says something otherwise. Judges are human beings. They are not only about the letter of the law when it comes to the interest of the child.”
