Did you forget that Erika Jayne and Tom Girardi aren’t legally divorced yet? Because if you did, here’s your reminder!
The RHOBH star was recently warned by the court that if she and her estranged husband, Tom Girardi, don’t get their divorce case moving, it could be thrown out.
According to new legal docs obtained by TMZ, a hearing has been set for early next year, where Erika and Tom were ordered to appear in court and explain why their divorce has been stalled for years.
The parties were warned that if they can’t give the judge a convincing reason for the delay, the case could be dismissed without a final judgment.
ICYMI: Erika and Tom split back in 2020 as the former lawyer was on the precipice of legal and financial troubles.
Tom was sentenced to 87 months in federal prison in 2025 after being found guilty of scamming his former clients out of settlement funds.
Since his conviction, Tom has reportedly been diagnosed with dementia and other health issues.
As we saw play out on RHOBH, Erika was both optically and literally dragged into some of the lawsuits surrounding her estranged husband.
However, she has maintained that she knew nothing about his business dealings.
