The circumstances surrounding KJ Biermann’s case date back to February 2025, when his parents, Kim Zolciak and Kroy Biermann, were embroiled in their contentious divorce.
On Feb. 18, 2025, Kim filed a motion seeking an emergency hearing in Fulton County, Georgia. In the filing, the former Real Housewives of Atlanta star claimed Kroy had taken possession of their children’s cellphones and restricted her access to the kids after he allegedly made a “discovery” that remains redacted from publicly available court documents.
Kim also filed a heavily redacted motion. She requested an in-camera inspection, meaning the judge would privately review evidence outside of the public record.
The filing does not publicly identify what Zolciak wanted the judge to examine. However, a Feb. 21, 2025, filing referenced an order concerning the inspection of their “eldest child’s cellular telephone, and the data thereon.”
According to Kim’s emergency-hearing motion, Kroy told a court-appointed neutral mental health professional about the alleged discovery on Feb. 7, 2025. “In protecting the best interests of the children, Mother will not put into this public pleading what is alleged to be on REDACTED,” the motion stated.
Kim further alleged that Kroy subsequently “began battening down the hatches.” She claimed he “unilaterally directed Mother that she would no longer have parenting time with any of the children. He took possession of the children’s phones and prohibited the children from communicating with Mother.”
“Mother has had extremely limited parenting time. Mother has grave concerns for the children’s safety and wellbeing, as well as the preservation of evidence which may be (or may have been) stored REDACTED,” the filing continued.
The former couple subsequently filed a joint statement of dismissal in their Fulton County divorce case before refiling the proceedings in Cobb County.
Kim and Kroy agreed that their attorneys would seek an order governing the handling and inspection of their eldest child’s cellphone and the data stored on it. This is the same phone referenced in the Feb. 18 in-camera inspection motion.
The following month, the court entered an order sealing documents related to the matter. The publicly available court filings do not reveal the results of the inspection or what, specifically, prompted the dispute.
KJ has since been held at Atlanta’s Metro Regional Youth Detention Center following his Aug. 17 arrest.
